Building a Duplex in Dartmouth: Zoning, Permits, and Feasibility (2026)

Most "how to build a duplex" guides start with the building. The better question — the one that decides whether a duplex is even the right project — starts with the parcel: what is the most this piece of land can legally and economically become? In Dartmouth, part of the Halifax Regional Municipality (HRM), the answer changed materially in 2024, and a duplex is now often the floor of what a lot supports rather than the ceiling.

This guide reflects that lens: it walks through Dartmouth's current zoning rules, the HRM permit path, the costs and programs that move the pro forma, and the tax rules that govern a rental once it's built — all grounded in primary sources and current as of June 23, 2026.

Step 1 — Read the parcel before you read the plans

The single most important fact for a Dartmouth duplex in 2026 is that HRM no longer restricts low-density residential lots to one or two units. Under the municipality's Housing Accelerator Fund (HAF) planning amendments, which took effect June 13, 2024, a minimum of four dwelling units is permitted as-of-right on every centrally serviced (central water and wastewater) residential lot across HRM [1][2]. The amendment package was approved by Regional Council at second reading on May 23, 2024, following a public hearing on May 21–23, 2024 [1].

What this means in practice for a Dartmouth owner:

• A duplex (two units) is generally permitted as-of-right wherever the lot is on central services and meets the applicable Land Use By-law standards.
• The same lot may also support three or four units as-of-right — so before committing to a duplex, it's worth confirming whether a triplex or fourplex is feasible on the same footprint and servicing.
• "As-of-right" means the project complies with the Land Use By-law and can proceed via a development permit without a discretionary approval; a minor relaxation of a specific standard (a setback or lot-coverage figure) is a variance granted by a development officer, while larger departures require a development agreement or rezoning approved by Council [3].

A note on the older framing: guides that tell you a duplex requires "R2 zoning" and that "most lots are R1, so you must rezone with Form ZM-01" describe a pre-2024 world. The HAF reforms folded much of that low-density single-unit gating away on serviced land. Rezoning is now the exception, not the default, for a small multi-unit project on a serviced Dartmouth lot. Verify your specific parcel's zone and unit yield against HRM's mapping (ExploreHRM) and the applicable Land Use By-law — minimum lot area and frontage are zone-specific, and there is no single municipality-wide minimum lot size [4].

As of 2026-06-23: the four-units-as-of-right allowance excludes the African Nova Scotian Beechville Community, which was deliberately carved out of the upzoning [5]. Dartmouth lots are not in that exclusion, but it's a reminder that the rule is geographic, not universal.

If your parcel is in the Regional Centre

Parts of Dartmouth fall inside HRM's Regional Centre, which has its own Land Use By-law and Established Residential (ER) zones. After the June 2024 HAF amendments:

• ER-2 permits single- and two-unit dwellings plus one backyard suite as-of-right; it does not permit triplex or fourplex new construction [6]. Maximum building height is 11 metres, with a 3-metre exemption for a pitched roof or attic unit [6].
• ER-3 permits up to eight dwelling units per lot, lot-size dependent — scaling from roughly four units on smaller lots up to eight on larger ones, via single/two/three/four-unit dwellings, small multi-unit (5–8 units), and townhouses [7]. Maximum building height is also 11 metres, plus the 3-metre pitched-roof exemption (up to roughly 14 metres with a sloped roof) [7]. Minimum lot area for 1–4 units in ER-3 is 325 m² [8].

For a duplex specifically, both ER-2 and ER-3 work — but if your lot is ER-3, the same parcel may carry far more, and the economics of a fourplex or small multi-unit building are usually stronger per dollar of land. This is exactly the trade-off a feasibility study exists to resolve.

Step 2 — The HRM permit path

Building regulation in Nova Scotia is provincial law, but permits, inspections, and occupancy are administered and enforced at the municipal level — so in Dartmouth you deal with HRM's Planning & Development office, and fees and processing follow HRM's schedule [9].

The typical sequence:

1. Development permit — confirms the project complies with the Land Use By-law (use, setbacks, height, lot coverage, parking). For an as-of-right duplex this is the gate that matters; you are not seeking discretionary approval, only confirmation of compliance [3].
2. Building permit — issued against detailed construction drawings (floor plans, elevations, foundation details, sections) demonstrating compliance with the building code. HRM reviews for building standards, structure, and fire safety before issuing [9].
3. Inspections through construction, then a final inspection.
4. Occupancy permit — required before occupying any building other than a single dwelling, shed, or pool. A duplex therefore needs one. It requires a valid building permit and a passed final inspection, and HRM will not issue it while items such as a final lot-grading certificate are outstanding [10].

Permit fees (effective April 1, 2024). For new construction of residential buildings of four units or fewer — which includes a duplex — HRM charges per square metre of floor area: $4.04/m² for floors at or above average finished grade, $3.36/m² for below-grade floors not more than 1.67 m deep, and $1.35/m² for deeper basements and garages, with a $31.25 minimum [11]. If you demolish an existing structure first, a separate demolition permit is required, with a fee of $62.50 plus possible engineering-related fees [12].

Timelines. Nova Scotia does not set a province-wide statutory deadline for permit review. As a practitioner estimate, HRM residential reviews are commonly described as roughly four to eight weeks, and multi-unit developments several months — but these depend on application completeness and are not legislated maximums [13]. The fastest way to compress this is a complete, code-compliant application the first time.

The building code your duplex must meet

A duplex is almost always a Part 9 building under the National Building Code as adopted in Nova Scotia — the simpler "Housing and Small Buildings" path applies to buildings three storeys or fewer with a building area not more than 600 m² that are not an excluded major occupancy [14]. Nova Scotia adopted the National Building Code of Canada 2020 (plus the 2020 energy and plumbing codes), in force April 1, 2025 [15].

Energy performance is phasing in by tier. Building code Tier 1 and energy code Tier 1 took effect April 1, 2025; building code Tier 2 takes effect April 1, 2026, with later tiers following through 2029 [16]. For houses and small buildings, the Section 9.36 energy requirements call for at least Tier 2 (Climate Zone 6) as of April 1, 2026 [17]. Design your duplex to the tier in force at permit time, not last year's.

One accessibility note: Nova Scotia's Built Environment Accessibility Standard (N.S. Reg. 48/2025) applies to construction beginning on or after April 1, 2026, but private residences with three or fewer dwelling units are explicitly excluded [18] — so a duplex is outside that standard (the National Building Code's barrier-free entrance provisions still apply where relevant) [19].

Step 3 — What to budget (and what those numbers don't include)

Helio publishes no construction price of its own. For an honest planning range, the best primary reference is CMHC's Housing Design Catalogue, which provides Class-B construction-cost estimates on a Halifax basis.

For small multi-unit buildings, CMHC's Halifax Q1-2025 estimates put hard construction cost at roughly $223–$345 per square foot, and on a per-unit basis roughly $217,000–$387,000 per unit depending on building type [20][21]. As a secondary cross-reference, Altus Group's 2025 Canadian Cost Guide reports Halifax wood-frame figures in a narrower, shell-basis range; treat it as a corroborating band rather than an all-in number [22].

Two caveats are essential to using these figures well:

• They are hard costs only. They include the general contractor's overhead and profit but exclude land, financing/cost of borrowing, soft costs, and the developer's overhead and profit; CMHC advises adding a 5–10% contingency and adjusting for inflation and exact location [23]. A single all-in "$X per square foot" headline number — the kind older guides quote — is misleading precisely because it hides this scope.
• Costs are still rising. Halifax residential building construction prices rose 3.9% year-over-year in Q4 2025 (low-rise apartments +4.0%) per the StatCan Building Construction Price Index [24], and the broader 15-CMA residential composite rose 2.8% year-over-year in Q1 2026 [25]. The Construction Association of Nova Scotia has characterized materials-and-building costs as having roughly doubled since 2020 [26]. Adjust 2025 catalogue figures forward.

Beyond hard costs, budget for servicing charges. Halifax Water levies a Regional Development Charge per new unit, effective April 1, 2024: $5,405.81 per unit for multiple-unit dwellings and $8,048.66 per unit for single-unit dwellings and townhouses [27]. These have been frozen at 2023 levels under an HRM Charter amendment, though increases have been under engagement [28].

Finally, HST. Nova Scotia's HST rate is 14% (5% federal + 9% provincial), reduced from 15% effective April 1, 2025 [29], and it applies to new construction on top of hard cost.

Step 4 — The financing and tax rules that shape the pro forma

A duplex sits in a particular spot in the federal incentive landscape, and knowing where it falls prevents budgeting for money you won't get.

• The enhanced Purpose-Built Rental Housing (PBRH) rebate — which refunds 100% of the GST/federal HST and, in Nova Scotia, 100% of the 9% provincial part — generally requires the project to qualify as purpose-built rental. Where a duplex does not meet the enhanced PBRH criteria, the applicable rebate is the base New Residential Rental Property (NRRP) rebate: 36% of the GST/federal part of HST, to a maximum of $6,300 per unit, phasing out for unit fair market value between $350,000 and $450,000 and nil at $450,000+ [30][31][32]. Confirm which rebate your structure qualifies for before relying on either.
• CMHC's flagship multi-unit programs start at five units. Both MLI Select mortgage loan insurance and the Apartment Construction Loan Program (ACLP) have a minimum of five units [33][34]. A two-unit duplex does not qualify on its own — another reason to test whether a fourplex-plus-one or small multi-unit building on the same lot crosses that threshold and unlocks better financing.
• For an owner-occupied duplex, CMHC homeowner insurance allows up to 95% loan-to-value on one-to-two-unit owner-occupied homes (90% on three-to-four units), with 30-year amortization available to first-time buyers and all buyers of newly built homes as of December 15, 2024 [35][36].
• Depreciation. A new rental building is generally Capital Cost Allowance Class 1 at 4% declining-balance [37], but eligible new purpose-built rental buildings qualify for an accelerated 10% CCA rate where construction begins on or after April 16, 2024 and before 2031 [38]. The Accelerated Investment Incentive also suspends the half-year rule for eligible property [39].

A planning note on incentives that have closed, so you don't budget for them: Nova Scotia's Secondary and Backyard Suite Incentive Program has ended [40]; Efficiency Nova Scotia's SolarHomes rebate closed to homeowners on April 17, 2025 [41]; and the Canada Greener Homes Grant is closed [42]. HRM's municipal Secondary Suite Incentive (an infrastructure-cost grant funded under HAF) remains available and was expanded by Council on January 27, 2026 [43].

Step 5 — What a development firm actually does here

The construction phases of a duplex — site preparation and foundation, structural framing and weatherproofing, then interior mechanical, insulation, drywall, and finishes — are real, sequential, and best executed by experienced HRM builders. CMHC's Spring 2026 Housing Supply Report flags skilled-labour shortages with many Halifax builders near full capacity [44], which is one reason builder selection and scheduling matter as much as design.

But the decisions that determine whether a Dartmouth duplex is the right project are made before the first inspection: reading what the parcel allows as-of-right after the 2024 reforms, testing duplex against triplex or fourplex on the same land and servicing, sizing the pro forma against current hard-cost ranges plus the rebates and charges that actually apply, and confirming the code tier in force at permit time. That is the work Helio establishes — and then structures and coordinates on land the client owns.
